1. Definitions
“Qarakata” refers to the online marketplace where buyers and vendors transact.
“Vendor” refers to independent sellers who offer goods or services for sale on Qarakata.
“Buyer” refers to individuals or entities purchasing goods or services through Qarakata.
“Platform” refers to the Qarakata website and mobile application.
“Product” refers to goods or services listed for sale by vendors on Qarakata.
2. Contractual Agreement
When a vendor lists products and a buyer makes a purchase through Qarakata, a binding contract is formed between the vendor and the buyer.
Qarakata acts as a facilitator and is not responsible for the actual transaction between vendors and buyers.
Both vendors and buyers agree to comply with these terms when using the platform.
3. Vendor Responsibilities
Product Listings: Vendors must ensure that their listings, including product descriptions, prices, and images, are accurate, complete, and truthful. Misleading or deceptive information is prohibited.
Compliance with Laws: Vendors are responsible for ensuring that their products comply with applicable laws, including intellectual property, health and safety, and consumer protection regulations.
Fulfillment of Orders: Vendors agree to fulfill orders promptly and accurately. Vendors are responsible for packaging and shipping products to buyers within the timeframe specified at the time of purchase.
Refunds and Returns: Vendors must provide clear policies on refunds, returns, and exchanges in compliance with applicable laws and Qarakata’s platform policies.
Ownership and Rights: Vendors must ensure they have full ownership or legal rights to sell the products listed. Any counterfeit, illegal, or infringing products are strictly prohibited.
4. Buyer Responsibilities
Account Information: Buyers must provide accurate and up-to-date information, including payment and shipping details.
Purchasing Products: When a buyer makes a purchase, they agree to pay the listed price for the product, along with any applicable taxes, shipping, or handling fees.
Prohibited Activities: Buyers must not engage in fraudulent activity, including submitting false claims, chargebacks without cause, or making purchases with stolen or unauthorized payment methods.
5. Payments and Fees
Facilitation: Qarakata facilitates payments between buyers and vendors using third-party payment processors.
Payment Methods: Buyers can use accepted methods of payment, such as credit/debit cards, mobile payments, or bank transfers, to make purchases.
Service Fees: Vendors agree to pay any applicable fees charged by Qarakata, including listing fees, commission on sales, and optional service fees for premium services. These fees are outlined in Qarakata’s vendor dashboard.
Taxes: Vendors are responsible for determining and paying any applicable taxes on sales made through Qarakata. Buyers may also be responsible for taxes based on their location.
6. Refunds and Returns Policy
For Vendors: Vendors must provide a clear return and refund policy on their product listings. Vendors are expected to honor returns, refunds, or exchanges in accordance with the policy stated at the time of purchase.
For Buyers: Buyers must review the return and refund policies before making a purchase. If a product is defective, not as described, or not delivered, buyers may request a refund or replacement through the platform’s dispute resolution process.
Disputes: Qarakata offers a dispute resolution process for conflicts between vendors and buyers. Both parties are expected to cooperate in good faith to resolve issues related to refunds, returns, or undelivered items.
7. Shipping and Delivery
Vendor Responsibility: Vendors are responsible for shipping and delivery of purchased products within the time specified in the listing. Shipping costs, delivery times, and applicable policies must be clearly stated in the product listing.
Buyer Responsibility: Buyers must provide accurate shipping information. Any delays or non-delivery resulting from incorrect information are the buyer’s responsibility.
Delays: Vendors must notify buyers of any expected delays in delivery. If a product is not delivered within the specified time, buyers may request a refund or cancellation of the order.
8. Prohibited Items
Vendors are prohibited from listing or selling items that:
Violate any local, national, or international law or regulation.
Infringe upon the intellectual property rights of others.
Are deemed harmful, hazardous, or dangerous, such as weapons, explosives, or harmful substances.
Promote hate speech, violence, or discrimination.
Qarakata reserves the right to remove any listings that violate these conditions or are deemed inappropriate.
9. Intellectual Property
Vendor Content: Vendors retain ownership of all content provided for product listings, including text, images, and designs. By listing products on Qarakata, vendors grant Qarakata a non-exclusive, royalty-free, worldwide license to display, promote, and distribute the content through the platform.
Buyer Content: Buyers may not copy, distribute, or misuse vendor content without permission. Any unauthorized use of intellectual property may result in legal action.
10. Limitation of Liability
Qarakata is a platform facilitating transactions between independent vendors and buyers and is not responsible for the quality, safety, legality, or accuracy of products listed by vendors.
For Vendors: Qarakata is not liable for any financial loss, reputational damage, or legal consequences arising from a vendor’s failure to comply with these terms or applicable laws.
For Buyers: Qarakata is not liable for any dissatisfaction or harm resulting from a purchase. Buyers must address concerns directly with the vendor through the platform’s dispute resolution process.
11. Suspension or Termination of Accounts
Qarakata reserves the right to suspend or terminate vendor or buyer accounts for violations of these terms, including:
Fraudulent activity.
Repeated disputes or failure to fulfill obligations.
Breach of intellectual property rights.
Failure to pay applicable fees.
12. Privacy and Data Protection
Commitment: Qarakata is committed to protecting the privacy of its users. Our Privacy Policy outlines how we collect, store, and use personal information provided by vendors and buyers. By using the platform, you agree to the terms of our Privacy Policy.
Vendor Compliance: Vendors must comply with all applicable data protection regulations when collecting and processing buyers’ personal information.
13. Changes to Terms and Conditions
Qarakata reserves the right to update these terms and conditions at any time. Users will be notified of significant changes, and continued use of the platform after such updates constitutes acceptance of the revised terms.
14. Governing Law
These terms and conditions shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions. Any disputes arising under these terms shall be resolved through the courts of England and Wales.
